1. Agreement to Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SOMA LUXE® at Soma Luxe Body Boutique ("Company," "we," "us," or "our") governing your access to and use of our website, online store, content, and related services (collectively, the "Services"). 4. Legal Compliance – Canada and United States

The User agrees to comply with all applicable municipal, provincial/state, and federal laws governing the sale, possession, display, transport, or use of adult-oriented products, including but not limited to:

In Canada:

  • Criminal Code (R.S.C., 1985, c. C-46) — including Section 163 pertaining to the distribution or possession of obscene materials.

In the United States:

  • 18 U.S.C. § 2257 Record-Keeping Requirements for visual depictions of sexually explicit conduct, where applicable.

  • State-specific obscenity, age verification, and postal delivery laws related to adult goods.

In no event shall SOMA LUXE®’s total liability exceed the amount paid by the User for the specific product or service giving rise to the claim.

You agree to defend, indemnify, and hold harmless SOMA LUXE® and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, and expenses arising out of:

  • Your violation of any provision of these Terms;

  • Your violation of applicable law or the rights of any third party.

 

 

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Users in the United States agree to submit to the jurisdiction of the courts located in British Columbia, Canada, for all disputes arising out of or related to these Terms or the Services.

 

 

16. Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and such determination shall not affect the validity of any other provisions.

 

 

17. Termination
